Can I appeal a Hackney PCN for parking in a restricted street?
Yes. Code 01 (parked in a restricted street during prescribed hours) depends on the restriction signs and yellow lines being clear and properly maintained. If the yellow lines were broken or faded, or if the restriction plate was damaged or missing, photograph the evidence and include it in your informal challenge. Can I appeal a Hackney PCN for not displaying a pay-and-display ticket?
Yes. Code 06 (parked without clearly displaying a valid ticket) can be challenged if you purchased a ticket but it was not visible from outside the vehicle (blown off the dashboard, facing down or obscured by sunlight). Include a photograph of the ticket alongside your appeal. If you paid by RingGo or another app and the session did not register, export your payment history and include it as evidence.
Can I appeal a Hackney bus lane PCN?
Yes. Code 34 (being in a bus lane) requires Hackney to show CCTV footage of your vehicle in the lane during restricted hours. Grounds include: the restriction times shown on the sign did not apply when the PCN was issued, the camera footage shows you were not in the bus lane, or the road markings at the relevant point were unclear. Request the footage from Hackney and review the timestamps against the restriction hours on the signage.
What are the exemptions for Hackney LTN filters?
Hackney LTN exemptions vary by neighbourhood but typically include: blue badge holders (badge must be displayed), residents inside the zone who hold an authorised exemption permit, certain healthcare and emergency vehicles and vehicles making deliveries to properties within the filter area in specific circumstances. If you believe you qualified for an exemption, include your permit, badge or other documentation in your representations and identify the specific exemption category that applied.
What if I did not know the Hackney LTN filter existed?
Lack of awareness of an LTN is not in itself a ground for cancellation, but it can be relevant if the signage at the filter point was inadequate. If the ANPR camera sign was absent, facing away from approaching traffic, or showed only a time restriction without a clear prohibition notice, these are valid grounds. Visit the location and photograph the signs as they currently appear. Hackney's LTN programme is one of London's largest and some filter signage has been subject to challenge at London Tribunals.
How do I request camera footage for a Hackney PCN?
Submit a subject access request (SAR) to Hackney Council's data protection officer citing UK GDPR. Specify your registration number, the date and the camera location. Hackney must respond within 30 days. LTN ANPR footage is typically retained for 30 to 90 days, so submit your request promptly after receiving the notice. You can also ask for the CEO's observation notes and any photographs taken at the time of a CPZ or CPZ contravention.
What happens if I ignore a Hackney PCN?
Ignoring a Hackney PCN leads to a charge certificate adding 50% to the penalty, then a county court order via the Traffic Enforcement Centre. Enforcement agents can recover the outstanding amount with their own fees on top. Given Hackney's high enforcement volume, ignoring is not a viable strategy. Respond within 28 days: either pay the discounted amount or submit an informal challenge.
